3. How We Use Your Information
We use the information we collect for the following purposes:
- Service Delivery: To provide, operate, and maintain the ElkConstruct platform, including processing construction estimates, managing bids, and facilitating document collaboration.
- Estimate and Bid Processing: To power our AI-driven estimating engine, generate cost predictions, analyze bid documents, and provide intelligent recommendations for your construction projects.
- Account Management: To communicate with you about your account, respond to support inquiries, send transactional notifications (such as bid status updates, deadline reminders, and payment confirmations), and verify your identity.
- AI and Machine Learning Improvements: To improve our AI models and algorithms using anonymized and aggregated data only. Individual project data is never used to train our models in a way that could identify you or your company. You may opt out of this use at any time.
- Product Updates: To send you product announcements, feature updates, newsletters, and other marketing communications. You may opt out of marketing communications at any time by clicking the unsubscribe link in any email or updating your notification preferences.
- Security and Fraud Prevention: To detect, prevent, and respond to security incidents, fraud, unauthorized access, and other malicious activities. This includes monitoring for suspicious login attempts, unusual usage patterns, and potential abuse of the platform.

4.1 Service Providers

- OpenAI: AI-powered document analysis and natural language processing. Data sent to OpenAI is not used for model training per our Data Processing Agreement.
- Anthropic: AI-powered cost prediction and estimate generation. Data sent to Anthropic is not used for model training per our Data Processing Agreement.
4.2 Legal Requirements
We may disclose your information when required to do so by law, in response to a valid subpoena, court order, or other legal process, or to protect the rights, property, or safety of ElkConstruct, our users, or the public. We will make reasonable efforts to notify you of such requests unless prohibited by law or court order.
4.3 With Your Consent
We may share your information with third parties when you have given us explicit consent to do so. For example, when you choose to connect a third-party integration or share project data with another user on the platform.
4.4 Business Transfers
In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your personal information may be transferred as part of that transaction. - Backup Data: Automated backups containing your data are retained for 90 days after account deletion, after which they are permanently destroyed.
- Legal and Compliance Data: Certain data may be retained for longer periods as required by applicable laws, including tax regulations, financial reporting requirements, and legal hold obligations.
- Anonymized Data: Anonymized and aggregated data that cannot be used to identify you may be retained indefinitely for analytics and product improvement purposes.

ElkConstruct is based in the United States, and your data is primarily stored and processed in the United States using Amazon Web Services (AWS) infrastructure in the us-west-2 (Oregon) region, with backup and disaster recovery capabilities in the us-east-1 (Virginia) region.
If you are accessing our Service from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where our servers are located and our central database is operated. The data protection and other laws of the United States may differ from those in your country.
