10DLC Messaging Policy

Our compliance policies for SMS and text message communications.

1. Overview

ElkConstruct, Inc. ("ElkConstruct," "we," "us," or "our") uses 10-digit long code (10DLC) numbers for sending SMS text messages to users who have explicitly opted in to receive notifications from our platform. 10DLC is an industry-standard system for application-to-person (A2P) messaging that enables businesses to send text messages through local phone numbers registered with The Campaign Registry (TCR).

This policy outlines our messaging practices in compliance with the Telephone Consumer Protection Act (TCPA), the Cellular Telecommunications Industry Association (CTIA) Messaging Principles and Best Practices, and the messaging policies of all major wireless carriers operating in the United States. We are committed to responsible messaging practices and maintaining the trust of our users.

2. Message Types

ElkConstruct sends the following categories of SMS messages, all of which are transactional or informational in nature and directly related to your use of our platform:

Account Notifications

  • Two-factor authentication (2FA) verification codes for account login and sensitive operations.
  • Password reset confirmation codes when you request a password change.
  • Security alerts notifying you of new device logins, unusual activity, or account setting changes.
  • Account status notifications such as subscription confirmations and payment reminders.

Bid Notifications

  • New bid invitations alerting you when a general contractor invites you to bid on a project.
  • Bid status updates notifying you when a bid is received, reviewed, accepted, or declined.
  • Deadline reminders for upcoming bid submission deadlines, sent at configurable intervals.
  • Bid revision requests when a project owner requests changes to a submitted bid.

Project Updates

  • Estimate approval notifications when a project estimate is approved by a reviewer.
  • Document upload alerts when new documents, plans, or specifications are uploaded to your projects.
  • Team mentions when a team member tags you in a comment, note, or discussion.
  • Milestone notifications for significant project events and status changes.

System Alerts

  • Scheduled maintenance notifications with advance notice of planned downtime windows.
  • Service disruption alerts in the event of unplanned outages affecting your projects.
  • Critical platform updates that may affect your active projects or workflows.

Important: We do NOT send marketing, promotional, or advertising messages via SMS. All text messages sent through our 10DLC channels are strictly transactional and directly related to your account activity and platform usage.

3. Opt-In and Consent

We require explicit, affirmative consent before sending any SMS messages to your phone number. We never send unsolicited text messages, and we never add phone numbers to our messaging lists without the number holder's direct authorization.

Opt-In Methods

Users may opt in to receive SMS messages through any of the following methods:

  • Account Registration: During the account creation process, users may check a clearly labeled checkbox that states: "I agree to receive SMS notifications from ElkConstruct for account alerts, bid updates, and project notifications. Message and data rates may apply. Reply STOP to opt out at any time."
  • Notification Preferences: Existing users may enable SMS notifications at any time by navigating to their account notification preferences page and toggling on SMS messaging for specific notification categories.
  • API Consent Parameter: For users interacting with our platform through the API, a consent parameter must be explicitly set to "true" when enabling SMS notifications for a given phone number.

Consent Records

We maintain comprehensive records of all consent obtained for SMS messaging. Each consent record includes the following information:

  • The date and time (UTC) when consent was granted.
  • The method through which consent was obtained (registration checkbox, preferences page, or API).
  • The specific message categories the user authorized (account, bid, project, system).
  • The phone number for which consent was granted.
  • The IP address and user agent associated with the consent event.

Consent records are retained for the duration of the user's account plus an additional three years following account termination or opt-out, as required by TCPA recordkeeping obligations.

4. Opt-Out Process

Users can opt out of receiving SMS messages at any time through any of the following methods:

  • Reply STOP: Reply with the keyword "STOP" (case-insensitive) to any SMS message received from ElkConstruct. We also honor the keywords "UNSUBSCRIBE," "CANCEL," "END," and "QUIT."
  • Notification Preferences: Log in to your ElkConstruct account, navigate to Settings > Notifications, and toggle off SMS notifications for individual categories or all categories.
  • Contact Support: Send an email to [email protected] with the subject line "SMS Opt-Out" and include the phone number you wish to unsubscribe.

Opt-out requests are processed immediately upon receipt. After opting out, you will receive a single confirmation message stating: "ElkConstruct: You have been unsubscribed and will no longer receive SMS messages. Reply HELP for assistance or visit elkconstruct.com." No further messages will be sent to your number after the confirmation.

By default, opting out applies to all SMS notification categories. If you wish to opt out of only specific categories while continuing to receive others, you can manage this through the notification preferences page in your account settings.

5. Message Frequency

Message frequency varies based on your account activity, the projects you are involved in, and your notification preferences. Below are typical message volumes for each category:

  • Account Notifications: Approximately 1-3 messages per month. These are triggered only by specific account events such as login verification, password resets, and security alerts.
  • Bid Notifications: Varies by project activity, typically 2-10 messages per month. Volume depends on the number of active bids and projects you are participating in.
  • Project Updates: Varies by team activity, typically 5-15 messages per month. Volume depends on team size, project complexity, and the frequency of document uploads and estimate changes.
  • System Alerts: Rare, typically fewer than 1 message per month. These are sent only for scheduled maintenance or service disruptions.

Users can customize their notification frequency and thresholds through the notification preferences page. Options include batching notifications into daily digests, setting quiet hours, and limiting the maximum number of messages per day.

Message and data rates may apply. Standard message and data rates from your wireless carrier apply to all SMS messages sent by ElkConstruct. Please contact your carrier for details about your messaging plan.

6. Content Standards

All SMS messages sent by ElkConstruct adhere to the following content standards to ensure transparency, compliance, and a positive user experience:

  • Every message clearly identifies "ElkConstruct" as the sender at the beginning of the message.
  • Every message includes opt-out instructions, either inline ("Reply STOP to opt out") or via a link to manage notification preferences.
  • All messages are directly relevant to the recipient's account activity and contain actionable information.
  • Messages do not contain promotional content, advertising, or marketing offers.
  • All messages comply with carrier content guidelines, including CTIA short code and 10DLC messaging best practices.
  • Messages are kept under 160 characters where possible to avoid message segmentation. When longer messages are necessary, they are optimized for readability across segments.
  • Messages do not contain links to third-party websites. Any links included point to elkconstruct.com or our official app domains.

7. TCPA Compliance

ElkConstruct complies fully with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. Section 227, and all related regulations issued by the Federal Communications Commission (FCC). Our compliance measures include:

  • Prior Express Consent: We obtain prior express consent from every recipient before sending any SMS messages. Consent is obtained through clear, conspicuous disclosure and affirmative action by the user.
  • Immediate Opt-Out Compliance: All opt-out requests are honored immediately and permanently (unless the user re-opts in). We never send additional messages after an opt-out is processed, except for the single confirmation message.
  • Internal Do Not Call List: We maintain an internal Do Not Call (DNC) list that is checked before every message is sent. Phone numbers that have opted out are permanently added to this list and are never removed without explicit re-consent from the number holder.
  • Time Restrictions: We do not send non-urgent SMS messages outside of business hours, defined as 8:00 AM to 9:00 PM in the recipient's local time zone. Security alerts (such as suspicious login notifications) are the only exception and may be sent at any time due to their time-sensitive nature.
  • Consent Records: We maintain detailed records of all consent and opt-out requests for a minimum of five years, in compliance with TCPA recordkeeping requirements and FCC guidelines.

8. Carrier Requirements

Our 10DLC messaging program is fully registered and compliant with all major carrier requirements:

  • Brand Registration: ElkConstruct is registered as a verified brand with The Campaign Registry (TCR), the industry-standard registry for A2P messaging.
  • Campaign Registration: Our messaging use case is registered as an application-to-person (A2P) notification campaign, categorized under "Account Notifications" and "Delivery Notifications."
  • Carrier Compliance: Our messaging program complies with the specific policies of all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, and US Cellular.
  • Trust Score: We maintain a high trust score with TCR through responsible messaging practices, including low complaint rates, consistent opt-out compliance, and adherence to content guidelines.
  • Throughput Management: We manage our message throughput in accordance with carrier-assigned limits to ensure reliable delivery and avoid message filtering or blocking.

9. Data Privacy

We take the privacy of your phone number and messaging data seriously. The following protections apply to all data collected in connection with our SMS messaging program:

  • Phone numbers collected through our platform are used solely for the purpose of delivering SMS notifications as authorized by the user. We do not use phone numbers for any other purpose.
  • We do not sell, share, rent, lease, or trade phone numbers or messaging data to any third party for marketing, advertising, or any other purpose.
  • Phone numbers are encrypted at rest using AES-256 encryption and are transmitted over encrypted connections (TLS 1.3) at all times.
  • Access to phone numbers and messaging records is restricted to authorized personnel on a need-to-know basis, with all access logged and audited.
  • Message delivery logs are retained for 90 days for troubleshooting and compliance purposes, then automatically purged.
